Thanks for your business and we hope you enjoy your stay! Please make sure you're comfortable with these terms; we strictly enforce them.
RESERVATIONS: All Reservations are subject to Bryce Mountain Escapes and Property Owner approval. Online rates are subject to change without notice. Should we have ANY issues with your reservation, we will contact you within 48 hours.
PROPERTY: Guest rents, for vacation purposes only, the furnished real property and improvements described in the property listing.
PAYMENT: Bryce Mountain Escapes requires Guests to pay in full at the time of reservation booking. For reservations booked prior to 30 days to the check-in date, we accept payment via credit card, eCheck, or paper check mailed to our office at 2565 Orkney Grade, Mount Jackson, VA 22842. Please make checks payable to Bryce Mountain Escapes. Reservations made within 30 days of the check-in date must be paid via credit card or eCheck. A 3% processing fee applies to all electronic payments.
SECURITY DEPOSIT: In lieu of security deposits, we purchase Accidental Rental Damage insurance for each booked reservation (see DAMAGE WAIVER below). If covered damages exceed the Program's $1,500 coverage limit, or if the damages are of a nature not covered by the insurance program, we will charge Guest's credit card for the cost to restore the property to its original undamaged condition. We agree to provide documentation of the damage/loss, and Guest grants us consent to charge their credit card for uncovered or excess damages.
CANCELLATION: We provide a full refund for cancellations made up to 30 days prior to the check-in date. Refunds for cancellations made within 30 days, but prior to five (5) days, of the check-in date depends on our ability to re-rent the same property during same time period for which the Guest has cancelled. We limit such potential refunds to the lesser of the re-rental amount or the Guest's reservation amount, less a $150 cancellation fee. Bryce Mountain Escapes does NOT issue refunds either for reservations cancelled within five (5) days of.the check-in date, or due to acts of nature such as: weather, road conditions, snow conditions, power outages or forest fires.
To help our Guests safeguard their pre-paid reservations against unforeseeable events, we partner with RentalGuardian® and InsureStaysTM. Given the strict cancellation/refund policy desired by our property owner-clients, we strongly encourage Guests to purchase optional travel insurance for a cost of 7%-10.8% of the reservation total (depending on level of coverage). Guests may purchase travel insurance at the time of booking or shortly thereafter. If Guest purchases travel insurance at the time of booking, it will show on the reservation breakdown. UNFORESEEN OCCURRENCES: Bryce Mountain Escapes does not assume liability for any loss, damage or inconvenience caused by, but not limited to, the following: weather conditions, natural disasters, pests, construction, acts of God, or other reasons beyond its control. Accordingly, Bryce Mountain Escapes does not provide refunds for such occurrences. We highly recommend that Guests consider acquiring travel insurance as discussed in CANCELLATIONS above.
UNAVAILABILITY: For any reason beyond the control of the Property Owner, the property becomes unavailable, Bryce Mountain Escapes may substitute a comparable property or cancel this Agreement and refund in full all payments made by Guest.
OCCUPANCY: Only the paying Guest and their identified party members may occupy the property. No unlawful activity or any other activity that constitutes a nuisance is permitted on the property. Approved Guests take full responsibility for all lost or broken items, and any damages to the property of any kind. Guest agrees to bear the cost to repair all damages that either exceed the Accidental Damage Program coverage limit or are not covered by the Accidental Damage Program.
CAPACITY RESTRICTIONS: The Max Occupancy for a property is based on the sleeping capacity the beds provided. For example, twin beds sleep 1 guest; double, queen and king beds sleep 2 guests each.. Extra guests beyond the Max Occupancy are not allowed without our advance written consent. Often, extra sleeping capacity is not possible at certain properties. Guests with occupants that exceed the Max Occupancy will be charged 10% of the nightly rental rate, per additional occupant.
ARRIVAL & DEPARTURE: Check-in time is no earlier than 4:00 PM on arrival date, and check-out time is NO LATER than 10:00 AM on the departure date. Early Check In and Late Check Out options may be available, but we cannot guarantee it. If Guest has not arranged for a late check out, Guest may be charged a $25 fee for each hour beyond 10am the property is occupied, at a minimum of one hour. If Guest as not vacated the property by 1pm, an extra nightly rental fee may be assessed and charged to Guest's credit card. We require the Guest's credit card on file either prior to or at the time of check-in as a means for the Guest to pay an charges that arise during their reservation period.
CONDITION OF PREMISES: All properties are available for vacation rental in functional, safe, as-is condition. Guest are responsible for inspecting the property's photographs and description on our website (www.brycemountainescapes.com). Guest shall, on arrival, examine the property, all furniture, furnishings, appliances, fixtures and landscaping, and shall immediately report if any such items are not in operating condition or are in disrepair. Reporting desired repairs does not give Guest the right to cancel their reservation or receive a refund of any payments made. We will make effort to repair items promptly, or provide Guest with an alternative comparable property if the inoperable item(s) materially impair the fit, form or function of the property.
DEPARTURE CLEANLINESS: Bryce Mountain Escapes will deliver the property to Guest in clean condition. We expect guests to leave our Host's property in substantially similar condition as arrival. Failing to follow the checklist below (also sent via email prior to Guest's departure), or otherwise leaving the property a mess (inside and/or outside), will result in a $150 excessive cleaning fee.
- Strip used beds and pile dirty linens by bedroom doors
- Place used towels and washcloths in the bathtubs
- Load and run the dishwasher; do not leave dirty kitchen items in the sink
- Turn off the lights
- Lock all doors and windows
- Set the air conditioning to 76 degrees or heat to 66 degrees
- Empty the refrigerator
- Pick up and dispose of all trash in provided exterior receptacles
- Remove pet poop from yard, walkways, and decks (yes, we really have to say this)
- Return keys to the reception office or key drop box
- Report any maintenance items to us by either calling or emailing us
DAMAGE WAIVER: Bryce Mountain Escapes purchases Accidental Rental Damage Protection for each booking, the cost of which we include in the advertised nightly/weekly rental rate. Guests cannot decline this Damage Protection. Accordingly, we do not collect deposits or pre-authorize contingency transactions on Guest credit cards as security against damages that may be caused by Guest.
Our Damage Protection Program covers up to $1,500 in accidental damage to the property that occurs during Guest's occupancy. Bryce Mountain Escapes is responsible for filing all program claims on behalf of Guests and the Guest may be notified in writing of any such claim. Guest verification may be required in certain cases.
GUESTS RESPONSIBILITIES UNDER THIS PROGRAM:
- Guest shall properly use, operate and safeguard the property including, if applicable, any landscaping, furniture, furnishings, appliances and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary;
- Report any accidental damage to Bryce Mountain Escapes when they occur;
- Verify damages when requested to do so by our staff;
- Notify the police (then us) in case of loss by theft;
- Take reasonable actions to protect damaged property from sustaining further damage.
We inspect our properties before and after each reservation. The Guest is responsible for costs to repair damage exceeding the Accidental Damage Program coverage limit. This Program does not cover intentional damage, damages resulting from the Guest's negligence, or damages from non-compliance with the terms of this Agreement.
PETS: Pets are welcome in properties whose owners permit them, which will be an available option at the time of reservation. If pets are not an available reservation option, pets are NOT allowed. If we discover unregistered pets on a property that allow pets, we will charge Guest the property's required per-pet fee. If we discover unauthorized pets on a property that DOES NOT allow pets, we will charge the Guest $100 per pet and either require the pets to be removed or ask the Guest to leave without refund.
NO SMOKING: All properties are non-smoking. If smoking occurs within the property, (i) Guest is responsible for all damage caused by the smoking including, but not limited to, stains, burns, odors and removal of debris; (ii) Guests may be required to immediately leave the property, or be evicted from the property without refund. Guests who smoke or burn anything other than wood in the fireplace within the property are subject to, at a minimum, a $250 extra cleaning fee. All Bryce Mountain Escapes properties reside in a woodland mountain community susceptible to forest fires. If smoking outdoors, please dispose of smoking materials responsibly.
NO PARTIES: No parties of any kind are allowed at our properties. All of our rentals are in residential areas and may NOT be used for weddings, receptions, parties, or large gatherings. Our community has a strict noise ordinance: no loud noises, music, vehicles, pets, etc. are allowed between the hours of 10:00 pm and 7:00 am. We have a No Tolerance Policy regarding excessive noise, parties, or disturbing neighbors. Violations can result in a fine of $25 per notice, and could result Guest's eviction and payment forfeiture
NO ILLEGAL SUBSTANCES: No illegal substances are allowed in our properties, and minors may not possess alcohol. Violations will result in Guest's eviction from the property without refund.
CLEANING: Bryce Mountain Escapes will deliver the property to Guest in clean condition. Should Guest's use and activity require cleaning services during their reservation period, we will charge Guest an extra cleaning fee depending on the nature of the extra cleaning requested.
LOST ITEMS OR LEFT ITEMS: Bryce Mountain Escapes assumes no responsibility for Guest's lost, stolen or abandoned items. Reasonable effort will be made to contact the Guest to arrange for return. We charge $25.00 plus shipping costs for any personal items returned at Guest’s request. Bryce Mountain Escapes shall not be held liable for the condition of such items. We may donate or sell any personal items not claimed after 30 days.
MAIL SERVICES: Guest may ship directly to the rented property using Fedex or UPS during the rental period; however, we can not guarantee delivery or security of the package. This will be up to the seller/shipping company and the Guest to arrange. **Bryce Mountain Escapes is not responsible for any lost, damaged or delayed deliveries. Forwarding or returning late deliveries after Guest has checked out will be subject to the the fee set forth in LOST ITEMS OF LEFT ITEMS.
TV/CABLE/INTERNET: Our owners provide cable & internet services as a convenience only, and these services are not integral to this Agreement. We will not provide refunds for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to service.
AIR CONDITIONING/HEATING: All properties are equipped with air conditioning. If so equipped, and if not regulated otherwise, Guest agrees that air conditioning shall not be set below 72 degrees and heat shall not be set above 78 degrees. Doors and windows shall be closed when either heat or air conditioning is operating.
SYSTEM(S) FAILURES: In the event the rental property sustains a failure of a system, including but not limited to water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, HVAC, Jacuzzi tub, sauna or other system or structural element, neither the property owner nor Bryce Mountain Escapes shall be liable to Guest for damages, and no refunds will be given for such failures. However, Bryce Mountain Escapes will make prompt effort to repair or replace the failed system or equipment, and in such event, Guest agrees to permit Bryce Mountain Escapes or its service provider to have reasonable access to the property to inspect and make such repairs.
ENTRY: Bryce Mountain Escapes and its representatives and agents have the right to enter the property at any time (i) for the purpose of making necessary or agreed repairs, decorations, alterations, improvements, for maintenance or to supply necessary or agreed services; (ii) to verify that Guest has complied with the terms of this Agreement; or (iii) in case of emergency. Bryce Mountain Escapes and its representatives and agents have the right to enter the property, upon reasonable notice of at least 24 hours, to show the property to prospective or actual purchasers, tenants, mortgagees, lenders, appraisers or contractors.
PARKING: All of our properties have private driveways or ample designated parking suitable for two vehicles per reservation. We do no charge parking fees. During winter, Bryce Mountain Escapes removes snow from the driveways of our properties. However, during severe storms, please be patient with the plow drivers. Different parties are responsible for different areas of snow removal throughout the Resort community; therefore, we may not be able to reach your property until others clear the roads leading to your property. Many of our properties are located on winding, narrow mountain roads that can be difficult to navigate during winter weather events. Please use great caution and be prepared. Please avoid parking on Resort roads.
TERMINATION OF OCCUPANCY: Upon termination of occupancy, Guest shall: (i) return all copies of all keys or opening devices to the property, including any common areas; (ii) vacate the property at the agreed upon time (see ARRIVAL & DEPARTURE above); (iii) vacate any/all parking and/or storage space; and (iv) deliver the property to Bryce Mountain Escapes in the same condition, less ordinary wear and tear, as received upon arrival.
PERSONAL PROPERTY AND INJURY: (i) Owner Insurance: Guest personal property, including vehicles, are not insured by Owner or the HOA against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Neither Owner nor Bryce Mountain Escapes insures against Guest's or registered occupant's personal injury due to any reason other than the condition of the property.
(ii) Guest Insurance: Bryce Mountain Escapes recommends that Guest carry or obtain travel insurance to protect Guest, their registered occupants and their personal property from loss or damage. Please visit here for options and details.
(iii) Indemnity and Hold Harmless: Guest agrees to indemnify, defend and hold harmless Owner and Bryce Mountain Escapes from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to Guest, their registered occupants, or their personal property.
MEDIATION: Guest agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.
JOINT AND INDIVIDUAL OBLIGATIONS: If there is more than one Guest, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other Guest.
ENTIRE CONTRACT: Time is of the essence. All prior agreements between Owner and Guest are incorporated in this Agreement, which constitutes the entire contract. It is intended as a final expression of the parties' agreement, and may not be contradicted by evidence of any prior agreement or contemporaneous oral agreement. The parties further intend that this Agreement constitutes the complete and exclusive statement of its terms, and that no extrinsic evidence whatsoever may be introduced in any judicial or other proceeding, if any, involving this Agreement. Any provision of this Agreement that is held to be invalid shall not affect the validity or enforceability of any other provision in this Agreement. The waiver of any breach shall not be construed as a continuing waiver of the same or any other subsequent breach.
RELEASE: In consideration of the right to visit the property, Guest agrees to release, to the fullest extent allowed by law, Owner and Bryce Mountain Escapes' members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates (collectively, the Affiliates) from all liability or responsibility of any kind whatsoever for any personal injury, death, property damage or other loss sustained by Guest, Guest's minor children, any occupant identified on the reservation, or any other person allowed onto the property during Guest's rental dates as a result of Guest's, Guest's children's, or other occupant's participation in a visit to the property, due to any cause whatsoever, including without limitation negligence on the part of Owner or Bryce Mountain Escapes. I understand that this release will bind my heirs, administrators, executors, and any other person or entity seeking to claim under or through me. |
